This Privacy Policy applies to all users of the Platform. By accessing or using the Platform, you agree to the terms of this Privacy Policy. If you do not agree, please do not use the Platform.

  • Full name and professional credentials;
  • Practice or clinic name and address;
  • Professional license number and state of licensure;
  • Email address and phone number;
  • Payment information (processed securely via third-party payment processor).

B. Order Information

  • Products ordered, quantities, and order history;
  • Shipping address and recipient information;
  • Payment transaction records.

C. Usage and Technical Information

  • IP address and device information;
  • Browser type and operating system;
  • Pages visited and actions taken on the Platform;
  • Cookies and similar tracking technologies.

2. How We Use Your Information

We use the information we collect to:

  • Create and manage your provider account;
  • Process and fulfill orders placed through the Platform;
  • Route orders to the appropriate FDA-registered 503B fulfillment partner;
  • Process payments and manage billing;
  • Communicate with you regarding your account, orders, and Platform updates;
  • Verify your professional licensure and eligibility;
  • Comply with applicable legal and regulatory obligations;
  • Improve and optimize the Platform;
  • Detect and prevent fraud or unauthorized access.

3. How We Share Your Information

We do not sell your personal information. We may share your information with:

  • FDA-registered 503B outsourcing facilities — to fulfill your orders and coordinate direct shipment to your practice;
  • Payment processors — to securely process transactions;
  • Technology and platform service providers — to operate and maintain the Platform;
  • Legal and compliance advisors — as needed to protect our rights or comply with applicable law;
  • Regulatory authorities — if required by law, subpoena, or government order.

All third parties with whom we share information are required to maintain appropriate confidentiality and security standards.

4. HIPAA and Protected Health Information

Omigenix is not a covered entity or business associate under HIPAA in the context of its platform operations. The Platform is a B2B ordering tool for licensed healthcare providers and does not collect, store, or process patient-specific protected health information (PHI). You are responsible for ensuring that any information you submit through the Platform does not include patient PHI unless required for order fulfillment and separately governed by a Business Associate Agreement.

5. Data Security

We implement commercially reasonable technical and organizational measures to protect your information against unauthorized access, disclosure, alteration, or destruction. Payment information is processed through secure, PCI-compliant third-party payment processors and is never stored on our servers.

No method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

6. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to operate and improve the Platform, remember your preferences, and analyze usage patterns. You may disable cookies through your browser settings, but doing so may affect Platform functionality.

10. Children's Privacy

The Platform is intended solely for licensed healthcare professionals and is not directed at individuals under the age of 18. We do not knowingly collect information from minors.

We may update this Privacy Policy from time to time. When we do, we will post the updated policy on the Platform with a revised effective date. Your continued use of the Platform following any update constitutes acceptance of the revised policy.
